Rental or Lease of District Property - 7250
The Board of Directors is authorized to rent or lease all or any portion of any surplus real property owned by the District, when it is determined to be in the best interest of the School District to do so. Surplus property may be rented or leased for any legal purposes whether for profit, non-profit, commercial or non-commercial uses, provided such use does not interfere with the District's educational program and related activities.
When the value of a rental or lease totals ten thousand dollars or more, the District will publish a written notice in a newspaper of general circulation in the School District; the District will not rent or lease the property for at least forty-five days following the publication of the newspaper notice.
Private schools will have the same rights as any other entity regarding rental or lease of surplus District property.
Moneys derived from real property will be deposited into the District's debt service fund and/or capital projects fund, except for:
- Moneys required to be expended for general maintenance, utility, insurance costs, and any other costs associated with the lease or rental of such property, which moneys will be deposited in the District's general fund; or
- At the option of the Board of Directors, after evaluating the sufficiency of the School District's capital projects fund for purposes of meeting demands for new construction and improvements, moneys derived from the lease or rental of real property may be deposited into the District's general fund to be used exclusively for nonrecurring costs related to operating school facilities, including but not limited to expenses for maintenance;
